General

The terms and conditions specified here administer the use of the services provided by Adaptable India. These terms and conditions shall apply to all individuals or entity who wants to avail the services of Adaptable India.

You are requested to read the terms and conditions very carefully. Once you register and avail the services of Adaptable India, you shall, in all circumstances comply with the provisions of the terms and conditions provided. Adaptable India reserves the right to terminate the contract or stop the services providing to the clients for any conduct which Adaptable India believes to be harmful for its business or the use of the service is harmful to others.

Adaptable India holds a right to modify or change the terms and conditions at any time, at its sole discretion, without any notice. Such modification or changes shall be made effective for all the clients after it is being informed in the website. Responsibility lies on the clients to read the terms and conditions from time to time to make sure that their service is in compliance with the terms and conditions.

Terms and Conditions

• Adaptable India pledges to impart quality services to the clients who want to avail it, to proceed with the services as per the project requirement, 100% of the total amount of the project is to be paid mandatorily.
• Adaptable India shall not be held liable, whatsoever, where the client uses the software developed by Adaptable India for any unethical, illegal or fraudulent work. We only responsible for developing the software according to client's requirements and deliver it.
• There is a fixed design structure in terms of the admin panel, member panel, franchisee panel and re-purchase system that will be developed in accordance with the first quotation of the project and cannot be changed once the order is placed. However, the clients will be able to change the color and functionality of the software only. If in case the client wants to make changes in the structure of the design of the software, they have to pay a higher amount for which a revised quotation will be send to the client and have to inform us about the intention to change the structure prior to placing of the order.
• A validity of 7 days will be offered to the clients to make the payment, which will be counted from the date mentioned in the quotation.
• Adaptable India will try their best to deliver the project to the client on the decided date. However, the date might change in compliance with the changing demands and requirements of the clients.
• There is an annual maintenance charge, which is 30% of the total amount of the software that the client is required to pay. This annual maintenance charge is mandatory and has to be paid prior to 1 week of the expiry of the software.
• Adaptable India only provides the service Software Development and Website Design as Requested by the Clients. Domain registration, Web Hosting, SSL certificate, Promotional/Transactional SMS and Other third Party add-on are to be provided by the Client.
• The quotation of the project that will be submitted to the client includes the source code with one domain License which is mentioned in the final quotation. Use of the source code in different domain is strictly prohibitate.
• Domain and Hosting details are to be provided by the client and must be changed after the successful completion of the project. If any requirement arises then client can share the above details with our technical team and again must change after the requirement has been completed.
• Adaptable India shall not be held liable for the alteration/modification/deletion of the source code by the client once we hand over the server details to the client after successful completion of the project.
• If in any case, the client makes a demand for extra modules, the client is required to pay an extra charge accordingly.
• Once Adaptable India delivers the entire project to the client, they cannot demand a refund if they are not satisfied with the project results.
• Third party integration on clients demand is chargeable and the charge shall not be included in the quotation. This has to be paid separately by the client.
• Any demand of add on modules are charged extra which is not included in the quotation.
• The payment from the client has to be made in the mentioned account address. For any payments made in personal accounts or otherwise will be deemed as non-payment and for any other replacement of payments we would not hold any responsibility.
• The time of delivery of the project is counted within business days, no holidays or Sundays are included.
• The work on the project will be started as soon as the client pays the 100% of the total amount.
• The quotation of the project submitted to the client is entirely of the software which excludes the components mentioned earlier, therefore no client can reject the components and demand to negotiate the price of the software. Client cannot make a demand to negotiate the price of the software on the ground of not accepting the components. He has to pay the full price that is quoted according to the project requirements.
• No technical support is to be provided to the clients on official holidays.
• Adaptable India offers to provide 1 year of technical support to the client after the delivery of the software.
• THE COMPANY PROVIDES THE SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT CONTAINED THEREIN), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON INFRINGEMENT.
